Le prêt relais est un prêt immobilier auquel il est possible d'avoir recours dans certaines conditions. Même si le prêt relais est en général d'une durée plus courte qu'un prêt immobilier normal, il est toutefois soumis aux mêmes conditions. Vous aurez donc également besoin de souscrire une assurance emprunteur. Si votre assurance emprunteur ne vous convient plus, il vous est tout à fait possible de changer d'assurance emprunteur pour votre prêt relais. Comment s'y prendre ?

Qu'est-ce qu'un prêt-relais et quel est son objectif ?

Dans le but d'acquérir un nouveau logement, il peut arriver que vous décidiez de vendre votre logement actuel afin de financer votre nouvel achat. Or, il n'est pas toujours facile de faire coïncider la vente de l'ancien logement avec l'achat du nouveau. Très souvent, vendre son bien immobilier actuel peut prendre de longs mois, ce qui risque de ne pas vous arranger, notamment si vous avez déjà trouvé le logement de vos rêves. C'est dans ce type de situation qu'intervient le prêt relais.

Pareillement connu sous le nom de prêt achat-vente, le prêt relais est un prêt immobilier qui vous permet de financer l'achat d'un nouveau logement sans que vous ayez besoin d'attendre de vendre l'ancien. Cela vous évite de souscrire un nouveau prêt immobilier dans le cas où vous n'auriez pas encore fini de rembourser le crédit immobilier de la maison que vous souhaitez mettre en vente.

En optant pour le prêt relais, la banque ou l'organisme financier vous avance une partie de l'argent nécessaire pour votre nouvelle acquisition, ce qui vous permet de bénéficier d'un délai supplémentaire pour vendre l'ancien logement. La durée du prêt relais est habituellement comprise entre 12 et 24 mois. Tant que le bien n'est pas vendu, vous n'aurez qu'à payer les intérêts à banque. Une fois le bien vendu, vous solderez votre crédit auprès de la banque.

Le prêt relais vous aide donc à acquérir un nouveau logement au plus vite sans que vous ayez besoin d'attendre la vente de votre ancien logement et sans avoir à augmenter vos dettes en souscrivant un second prêt immobilier.

Quelles sont les conditions pour changer d'assurance emprunteur ?

Vous souhaitez changer d'assurance emprunteur pour votre prêt relais ? C'est tout à fait possible, car la loi vous y autorise. La loi Hamon de 2014 a autorisé les emprunteurs à changer d'assurance emprunteur durant la première année du prêt immobilier, et ce, à condition de respecter un délai de préavis de 15 jours.

En 2018, la loi Bouquin va plus loin en offrant la possibilité aux emprunteurs de changer d’assurance emprunteur chaque année à la date d’anniversaire de leur contrat. Toutefois, ils se devaient de respecter un préavis de 2 mois. 

Depuis 2022, avec la loi Lemoine, vous êtes désormais libre de changer d’assurance quand vous le souhaitez.

Vous vous demandez sans doute comment changer d’assurance emprunteur lorsque votre assurance emprunteur actuelle ne vous convient plus ? Il n’y a rien de plus simple. Il vous suffit dans un premier temps de trouver un nouvel assureur. Vous n’aurez alors qu’à souscrire votre nouvelle assurance tout en veillant à résilier votre ancien contrat.

Pour résilier votre contrat d'assurance emprunteur, vous devez envoyer une demande de résiliation à l'assureur, que vous accompagnerez d'une demande de substitution d'assurance à votre banque. Si vous souhaitez réellement changer d'assurance emprunteur, votre nouveau contrat doit toutefois respecter toutes les garanties minimales fixées par la banque. Si ce n'est pas le cas, alors la banque est tout à fait apte à s'opposer à ce changement.
